CA’s future digital protocol and the power of technology in streamlining transactions

The Conveyancing Association released its Future Digital Conveyancing Protocol document in September. It encourages conveyancers to make use of a range of digital services to improve the process for all involved. 

The aim is to increase conversion rates, minimise the amount of failed transactions and improve the time from the point of sale. This in turn helps towards a greater turnover of transactions and higher ROI.

It also places great importance on the use of Upfront Information (UFI) to speed up the process. This minimises time validating property information and instead lets you focus on using that information to help the client.

Director of Delivery at The Conveyancing Association, Beth Rudolf, commented:

“The Protocol fits in with our commitment to process improvement, and particularly to the greater use of Upfront Information, combined with digital ID and signatures, and chain-view technology, property logbooks, etc which we believe will provide a huge step forward and drastically reduce the time it takes to complete and the wastage within our industry.”

What does the protocol recommend conveyancers do?

The protocol was released ahead of upcoming legislation on digital ID verification and the use of digital signatures with the HM Land Registry. The Conveyancing Association recommend the following to benefit both you and your client:

  • Smartphone access – Upon instruction, conveyancers are advised to ask buyers and sellers if they have access to a smartphone so they can sign and be identified digitally. 
  • Provide agent summary – The conveyancer must compose a list of information that could affect the ‘buyer’s transactional decision’ and give this to whoever is marketing the property.
  • Digital TR1 form The CA also recommends drafting the TR1 form through HMLR’s digital registration service and signing electronically to be more efficient.
  • Signing and exchanging contracts –  “Digital signature and qualified electronic signature technology” must be used for signing contracts and the use of a secure email system to exchange contacts is also recommended, whenever both are possible.
