Parts B and C upfront information released

The National Trading Standards Estate and Letting Agency Team (NTSELAT) released Parts B and C of their material information guidelines back in November. NTSELAT claims this is what should be included in all property listings going forward as it’s now classed under Consumer Protection Regulations.

In 2022 we saw the first phase of this released with Part A rules meaning all property listings must include the following:

  • Property/rental price
  • Council tax band
  • Tenure information

With the release of Part B and C, all property listings should now include the following information:

Part B:

  1. Physical characteristics of the property
  • 1.1. Property Type
  • 1.2. Material type/materials used in construction
  1. Number and type(s) of room(s) NTSELAT’s view is that the numbers and types of room are always considered material information for every property listing.
  2. Utilities
  • 3.1. Electricity Supply
  • 3.2. Water supply
  • 3.3. Sewerage
  • 3.4. Heating
  • 3.5. Broadband
  • 3.6. Mobile Signal/Coverage
  1. Parking

Part C: 

  1. Building Safety
  2. Restrictions and Rights
  • 2.1. Restrictions
  • 2.2. Rights and Easements
  1. Flood/Erosion Risk
  • 3.1. Flood risk
  • 3.2. Coastal erosion risk
  1. Planning Permission or proposal for development
  2. Property Accessibility/Adaptations
  3. Coalfield or Mining Area

The main concern is how this will be policed. Listings missing this information will have explanations to inform buyers and renters what is missing. However, NTSELAT says that the overall aim is to prevent any listings without this information from being published on portals, which could delay the instruction of conveyancers.
