HMLR Practice Guide updates

HM Land Registry (HMLR) has published details of changes to several Practice Guides in its latest update.

 

First registrations (PG1)

This guide deals with the procedure to be followed when applying for first registration of unregistered estates in land. It does not deal with the effects of registration or the characteristics of the various classes of title with which land may be registered.

Change made: Section 4.4.4 has been amended to include a link to a form for the deposit of title deeds.

 

Leases: determination (PG26)

This guide gives information about the different situations in which leases are determined and how the determination affects registered titles. It gives advice on how to lodge an application with HMLR and sets out the documentation required in support of an application.

Change made: Note 3 to section 8 has been amended. The protection from forfeiture for non-payment of rent and recovery of rent for business tenancies in Wales has been extended to 25 March 2022 by the Business Tenancies (Extension of Protection from Forfeiture etc) (Wales) (Coronavirus) (No. 3) Regulations 2021, which came into force on 30 September 2021.

 

Coronavirus (COVID-19): useful information for conveyancers (PG80)

This practice guide:

  • Provides information about changes to HMLR’s practice to facilitate conveyancing and registration following the coronavirus (COVID-19) outbreak.
  • Identifies other practice guides containing information that may be of particular assistance in the current circumstances.
  • Gives brief details of legislation passed in response to the coronavirus outbreak and relevant to conveyancers.

Change made: Section 4.3 has been amended following the extension of protection from forfeiture for business tenancies in Wales to 25 March 2022. Section 4.4 has been amended because of further changes made pursuant to the Corporate Insolvency and Governance Act 2020 on the use of statutory demands and winding up petitions.
