Land Registry makes changes to their practice regarding fees

Fee changes to RX1

HM Land Registry have made changes to their current practice regarding fees where a form RX1 is required for a restriction.

But when is a form RX1 required?

A form RX1 is required when applying for:

• a standard form restriction as a standalone application;

• a standard form restriction when the application is not made in one of the forms or documents listed in rule 92(7) of the Land Registration Rules 2003; or

• a non-standard form restriction.

Current practice
Where a form RX1 is required but has not been lodged, the land registry currently request the completion of the form RX1. They complete the application lodged without entering the restriction if the form RX1 is not provided within the time requested. They currently accept a further application in form RX1 to be made without a fee, if lodged within one month of the original application.

What is changing?
From Thursday 10 December any follow-up application for the registration of the restriction will have to be accompanied by the appropriate fee.
