HMLR practice guide updates – April 2022

HMLR practice guide updates: PG1 and PG39. Also referenced: Practice Direction 51ZB

First registrations (PG1)

Page summary:

Guidance for conveyancers on how to register unregistered estates in land for the first time (practice guide 1).

Change made:

Section 4.6 has been amended. From 4th April, HMLR will be scanning first registration applications when they receive them. They will then process these applications electronically.

 

Rectification and indemnity (PG39)

Page summary:

Correction of certain types of mistake in the register (rectification) and the payment of compensation (indemnity) (practice guide 39).

Change made:

Sections 1.5 and 11 have been amended to clarify when HMLR may offer compensation in respect of maladministration.

 

Practice Direction 51ZB

From 4th April, legal professionals issuing claims for damages that fall under the scope of Practice Direction 51ZB should use the Damages Claim service on MyHMCTS. Legal professionals acting for claimants can find guidance and sign up on GOV.UK. A webinar demonstrating the damages service is now available on the HMCTS YouTube channel.
