A useful flow chart has been published to help conveyancers navigate the notoriously complex Building Safety Act 2022.
The informative tool comes as part of a wider information sheet on the Act. The sheet also contains information for conveyancers on the Fire Safety (England) Regulations 2022.
The sheet was put together by Ian Quayle of IQ Legal Training and Property Law UK in conjunction with Zahrah Aullybocus, Consultant Solicitor at NEXA Law.
Amidst “unprecedented demand”, the information sheet has been made free to access online by its authors.
In helping conveyancers to understand whether a Landlord and Leaseholder’s Certificate is required, the Building Safety Act flowchart asks a number of questions about the building and the leaseholder in question.
At each juncture in the chart, additional information and explanation is provided to the reader in plain English – something often said to be lacking from the Act itself.
With regards to Fire Safety issues, the sheet provides separate steps for conveyancers to take in cases of multi-occupational residential buildings over 18 metres or seven storeys in height, multi-occupied residential buildings over 11 metres in height, and all multi-occupied residential buildings containing two or more domestic premises sharing common parts.
The sheet rounds off with nine practice points for conveyancers to consider implementing.
